TOS (terms of Service)
1.) Account Setup We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under.
2.) Content All services provided by Genesis System.com may only be used for lawful purposes. This includes, but not limited to: copyrighted material, material we judge to be threatening or obscene, pornography. The customer agrees to indemnify and hold harmless Genesis System.com from any claims resulting from the use of our services. Examples of unacceptable material: IRC Bots Warez Sites Pirated Software Hate sites Hack programs and archives pornography obscene Gay or lesbian Adult or pornographic material including, but not limited to, sexually explicit or suggestive material Sexually oriented products or services (e.g. escort services), or other sexually oriented material Nudity, including airbrushing (exceptions granted on a case-by-case basis if for medical or artistic purposes) Lingerie websites Offensive or otherwise distasteful material Content or language that is harmful to minors in any way Bulk emailing tools Distribution of internet viruses or other harmful or destructive activities Hacking and cracking Scams or phishing for personal information Solicitation of funds other than for legal charitable organization (exceptions granted on a case-by-case basis at HIT’s discretion) Gambling, gaming, lotteries, and like activities Harmful, threatening, violent, abusive, harassing, tortuous, vulgar, obscene, libelous, invasive of another’s privacy, racial, chauvinistic, ethnically offensive, complaint websites, or otherwise objectionable content or language Defamatory, hateful or revenge content or language Aids to pass drug tests or aids to pass lie detector tests Illegal activities such as ponzi schemes, pyramid schemes, fraudulent charging of credit cards, copyright violations, plagiarism, software piracy, and all unauthorized use of materials or content that infringes on third parties’ intellectual properties MLM without a legitimate product or service, with a front product or service, or where the primary intent is to recruit new members rather than to sell products Reverse Funnel Systems Cash Gifting Illegal drugs or drug paraphernalia Prescription drugs and related content Alcohol sales Tobacco sales Miracle cures Fake documents Fireworks, pyrotechnics, firearms, explosives or weapons Intentional or unintentional violations of any applicable local, state, national or international law Reselling of email accounts or hosting accounts to third parties Reselling of any HIT services including, but not limited to, design services, updates, and WTD to third parties without a written re-seller agreement. Spamming and all other forms of unsolicited messages including, but not limited to, spam, chain letters, and junk email Links to other sites that are in violation of HIT's policies and guidelines Other activities, whether lawful or unlawful, that HIT deems to be in poor taste or that reflect adversely on HIT or HIT’s other clients HIT reserves the right to refuse to design or host an account at its sole discretion at anytime.
3.) Zero Tolerance Spam Policy We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account terminated without notice. Please read Genesis System.com/mailpolicy Genesis System.com reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. Genesis System.com also reserves the right to make any such modifications in an emergency at our sole discretion. Genesis System.com reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Genesis System.com. All rights reserved.
4.) Payment Information You agree to supply appropriate payment for the services received from Genesis System.com, in advance of the time period during which such services are provided. You agree that until and unless you notify Genesis System.com of your desire to cancel any or all services received, those services will be billed on a recurring basis. Genesis System.com reserves the right to change the monthly payment amount and any other charges at anytime.
By making the payment, you expressly affirm that you have carefully reviewed, comprehended, and fully accepted all provisions stated in our Terms of Service (TOS).
Your payment serves as your acknowledgment and acceptance of the terms outlined in the TOS. It is important to note that, in accordance with our TOS, no additional signature or documentation is required from you when making any payment.
Your payment itself acts as your explicit affirmation of understanding and agreement with the terms and conditions stated in the TOS.
We want to ensure that our customers are fully informed and satisfied with the services we provide. Should you choose not to agree to the TOS,
please be aware that your services will not be disconnected immediately. You will have a grace period of 30 days to make arrangements and transition your services away

5.) Backups and Data Loss Your use of the service is at your sole risk. Genesis System.com is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Genesis System.com servers.
6.) Cancellation and Refunds Genesis System Enterprices (genesissystem.com) or DBA ZoeVoip.com, reserves the right to cancel the account at any time. You can also cancel any time, once we receive your cancellation and have confirmed all necessary information with you, we will inform you in writing (typically email) that your account has been cancelled. Because cancellation is automated, GenesisSystem.com requires a written cancellation notice via the customer portal or emails a minimum of twenty-four (“24”) hours prior to 00:00:01 Easter Time on the Anniversary Billing Date for discontinuance or downgrades of month-to-month services. Failure to supply the requisite twenty-four (“24”) hours written notice of cancellation will result in a full billable monthly cycle prior to cancellation. Any server cancellation prior to the minimum deadline will remain online until the automated process reclaims your server on the Anniversary Billing Date. Notice of written cancellation is required through the online customer portal located at http://genesissystem.com All Customer data remaining after the cancellation date will be destroyed for security and privacy reasons, unless otherwise required by law. Genesis System.com gives you an unconditional 30 day money back guarantee on managed shared hosting, and reseller solution's. There are no refunds on dedicated servers. Refund requests after 30 days will be refunded on a prorated basis of any unused time. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us. Domain purchases are non refundable and can not be refunded. Reseller can cancel any time, but if you cancel before the first payment, you will be charge with $250.00 fee. If your website is finance by us and you decide to terminate or cancel after the first payment, you are entire to paid the full amount of the website
To cancel VoIP phone services. We strive to make the cancellation process as smooth as possible, while also protecting the interests of both parties. Please take note of the following cancellation policy for our VoIP phone services:
Notice Period: In order to cancel your VoIP phone services, you must provide us with a written notice of cancellation at least 30 days prior to the date on which you wish to terminate your services.
Method of Cancellation: All cancellation requests must be submitted in writing via email to our designated cancellation email address. genesis @ genesis system.com
Refund Policy: If you have a positive balance in your account at the time of cancellation, we will issue a refund for any remaining balance, unless otherwise stated in the terms of your contract.
Loss of DID Numbers: Please note that if you cancel your VoIP phone services, you will lose any Direct Inward Dialing (DID) numbers associated with your account. We recommend that you make arrangements to port your DID numbers to your new service provider.
Cancellation Fee: We do not charge a cancellation fee, unless otherwise stated in the terms of your contract.
7.) Resource Usage Users may not initiate the following: a) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc. b) Run any type of interactive real-time chat applications that require server resources. Remotely-hosted services are fully allowed. c) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD. d) Run any software that interfaces with an IRC (Internet Relay Chat) network. e)Run any bit torrent f) Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
8.) Bandwidth Usage You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
9.) Money back Guarantee On dedicated servers, and colocation no full refund will be honored, the 30 day money back guarantee does not apply. We reserve the right to refund a prorated amount or no refund at all. Each of Genesis System.commanaged shared, and reseller plans carries a 30 day unconditional money back guarantee on them. If you are not completely satisfied with our services within the first 30 days of your service, you will be given a full refund of the contract amount. Remember, this is ONLY for monthly shared or reseller packages, and not for dedicated servers.
10.) Price Change The amount you pay for hosting will never increase from the date of purchase. We reserve the right to change prices listed on Genesis System.com, and the right to increase the amount of resources given to plans at any time.
11.) Indemnification Customer agrees that it shall defend, indemnify, save and hold Genesis System.com harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Genesis System.com, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Genesis System.com against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Genesis System.com; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from Genesis System.com server.
12.) Attorney's Fees. In the event it becomes necessary for any party to this Agreement to resort to any legal proceeding to enforce any rights under this Agreement, the prevailing party in such legal proceeding shall be entitled to recover from the other party or parties, as the case may be, all of such prevailing party's costs in connection with such proceeding, including without limitation reasonable attorney's fees and costs of court.
13.) Disclaimer Genesis System.com will not be responsible for any damages your business may suffer. Genesis System.com makes no warranties of any kind, expressed or implied for services we provide. Genesis System.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by Genesis System.com and its employees.
14.) Shared accounts Shared accounts can not resell web hosting to other people, if you wish to resell hosting you must use a reseller account.
15.) Domain Name Transfer Away Policy You may transfer away from GenesisSystem.com any domain name that you have purchased via the GenesisSystem.com online ordering system to any other web hosting company or domain registrar at any time you desire providing the domain name is fully paid up, has not been refunded, has not been charged back and does not have any active or outstanding invoices due and is not in redemption. If GenesisSystem.com has control of the domain and you want control of the domain, GenesisSystem.com will transfer the domain to inside of GenesisSystem.com (Charge may applied) after the transfer is execute you can move your domain to another registrant.
